男子自行车刹车失效撞死行人被判缓刑
 

　　经交警部门认定，李世平承担本次事故的全部责任。事故发生后，李世平认罪态度较好，其家属能积极赔偿， 并取得了被害人家属的谅解。



　　据法院审理查明，2011年5月28日下午，奉节男子李世平骑一辆自行车，从奉节县新民镇九树村往李湾 村行驶。当日19时10分，当他行驶至新民镇九树村4组一下坡路段时，发现前面有一辆摩托车行驶很慢，便加 速行驶到摩托车左侧超车,破解QQ聊天记录，因刹车无效，将路边行人喻具超撞倒,手机窃听器哪里有卖，喻具超因伤情过重经奉节县人民医院抢救无效于5月29日凌晨死亡。

　　奉节县法院审理认为，被告人李世平违反交通管理法规，并致一人死亡，交通肇事罪罪名成立，鉴于归案后认 罪态度较好，并取得被害人的谅解,手机监听器，故可以酌情从轻处理，遂依法作出上述判决。

　　另据李世平事后交代，他当时知道这辆自行车的刹车失效了，但他以为，自行车速度慢，开出去没什么大不了 ，不会出啥事,手机监听器卡。
