高个男子因定做高尔夫球杆过短状告商家

　　本报讯 (记者张蕾)身高1.94米的朱先生定做了一套高尔夫球杆，却发现球杆过短，使用不适，影响成绩，遂告上法 庭要求退货。记者上午获悉,Nike Air Max Tailwind，朝阳法院已对此案作出一审判决，支持退货请求。

　　去年6月8日，朱先生在北京恩爱思高尔夫用品公司定做了一套高尔夫球杆，共13支，总价3.8万元。拿 到球杆后，在使用过程中，朱先生的击球成绩总不理想,nike shox。教练说他弯腰太多，难以做出正确的击球动作，因此影响击球成绩。

　　朱先生称，定做球杆时，恩爱思公司从未测量过他的任何个人数据。他身高1.94米,nike air max，使用的球杆应当比正常球杆更长，而他定做的这一套球杆比正常球杆还短。

　　朝阳法院经审理认为，恩爱思公司在为朱先生确定球杆数据时，未采取由定做人进行试用的方式方法，也未采 取任何科学技术手段对影响球杆使用效果的全部因素进行准确测量，而仅凭朱先生的陈述及公司经验，显然存在一 定履约瑕疵。此外，恩爱思公司未能提供足够证据证明其出具的数据经过了朱先生的确认，则该不利后果，理应由 恩爱思公司承担。

　　作为专家证人，中国高尔夫球协会副主席崔志强曾到庭作证。崔志强说，高尔夫球杆和运动员身高的问题，一 般因球员的本身情况和习惯而有所不同。定做球杆的过程一般是给做测试，然后根据数据得出一个结论。目前杆身 定做在国内是新行业，国内针对量身定做球杆没有相关规范和条款,cool nike air max。
