饭店油烟扰民成“老大难”

小饭店油烟噪音扰民已是老生常谈的话题了，在夏季夜宵市场喧嚣热闹的背后，小饭馆油烟扰民问题再次显现，随 想花园小区业主就为这一问题烦恼。
随想花园小区地处淮海北路淮安人民大会堂对面，记者前天接到报料后来到这家小区走访。上午9点多，一家小饭 店正在烹制龙虾，记者看到，这家正在烧制龙虾的饭店虽然安装了净化器，但就在净化器边的墙上有一个碗口大的 洞，油烟从洞口弥漫开来，整个院子里弥散着熟悉的十三香龙虾味。
院中有一个窨井，虽有井盖，但走在上面顿有热乎乎的感觉，稍作停留，立刻就能闻到从窨井中冒出的油烟味。沿 着院子向里走，买菜归来的业主陈先生说：“小区的油烟问题反映过多次，协调过多次，可症状并未完全好转。” 据陈先生介绍，他们小区不仅地上有味道，空中也有。小区共有4幢楼，由于每幢楼一楼都是门面房，二楼有一个 大平台供业主们出入。在3号楼前的平台上，一个凸起来的玻璃顶棚很显眼，顶棚外侧墙上有几个排气扇。“这个 门面以前是典当行，后来开了饭店，还搞起了烧烤，味道很大。”
记者走访看到，这家小区虽然不大，门面房却无一间闲置。由于地处淮海北路繁华地段，附近又有教育机构和单位 ，租门面开饭店的居多，临街的地方饭店林立。
陈先生和业主们称，他们小区是个老小区，油烟扰民问题也不是新问题。据介绍，前几年，小区业主曾向相关部门 反映过这个问题，经过多方座谈和协商，饭店也对油烟扰民问题进行了整改。但每到这个季节，夜市兴起，饭店的 油烟问题又开始显现。
走访：新老小区景象不同
由于家门口小饭店太多，熏人的油烟长期直排，周边住户整年不敢开窗户。扬子晚报记者在小饭馆比较密集的工农 电机路沿线小区走访看到，距离小饭店较近的民宅外墙上结起了厚厚的烟垢，少数约克空调外挂机被烟垢覆盖，机身都变成了黑色。
在一处被三家小饭店包围的小院里，居民们对此有苦难言。一位大妈悄悄地对记者讲：“家里的窗户基本上没开过 ，就这样，家具还得一周擦一次，久了就擦不掉了。”在这家小院，西侧有个小饭馆，大烟囱从墙口折弯下垂，但 端口并未插入地下，而是裸露在空中。对面还有两家临街的饭馆，一家安装了净化器，但破旧的设备 (反渗透装置和钛棒过滤器是水处理过程中不可或却的设备)只是个摆设，并未起到处理油烟的作用。“你看，那楼上都没有人住了，哪个受 得了啊！”这位大妈说。
记者来到小区饭馆相对集中的北京新村。记者发现，北京新村小饭馆虽多，但居民们大多能容忍。为何？“我们这 小饭店不少，但真正开在居民楼下的不多。你仔细看看，大多数饭店都开在只有两层楼的地方。”居民孙先生说， 北京新村的居民楼多，但在居民楼里开的大多是房产中介、小卖部。
“下回买房子再也不能买楼下是门面的了。”走访期间，记者听到不少这样的感叹。
“我们小区楼下有个面馆，装潢好了，净化器也装了，到最后没营业就关门了，原因是开面馆没有征得楼上人的同 意。”家住翔宇北道的卓先生说。在新落成的小区，业主维权意识显著增强，开饭馆的难度要大得多 。
治理：难就难在老饭馆
“新开的饭店相对好多了，问题集中在一些老饭店上。”一位社区工作者说。记者从社区走访得知，目前，市区正 在对“五小”行业进行摸底。受委托进行调查的社区工作者称，如果存在问题的小饭馆这次不按照规定进行整改， 将不能获得营业执照，环评也列入了这次整改的范围。
清河区环保局人士称，有些小饭馆的监管难是历史造成的。而现在，当小饭馆经营户面对投诉需要整改时，一时还 难以想通。另外，小饭馆的经营户大多是下岗和失业人员，他们自身也是弱势群体，因此，动辄几千乃至上万元的 投入改造，对这些人而言的确是一笔大支出。
维权：投诉无效可打官司
清河区环保局工作人员介绍，单就油烟排放来说，5个及以上灶头的饭店，或者是排气罩投影面积超过5.5平米 的饭店，在环评中都需要委托有资质的环评公司出环评报告，环保部门依据这份报告来进行审批。而规模相对小一 些的饭馆，虽然不需要出环评报告，但也要进行登记备案。
目前，饭店油烟的排放有三种方式：高空排放、入地排放及净化处理。对小饭店来说，一般要么配套 南京油烟净化器对油烟进行处理，要么将排气管入地排向下水道。直接排放是决不允许的。另外，小饭馆能否开业还须征得利害关 系人的同意。
法律界人士张先生认为，对小饭店扰民问题，业主不需要一忍再忍，可以诉诸法律，通过法律来解决这一烦恼。（ 记者 江安 唐栋梁）
