民宅疑因鼠洞涌入半吨泥浆续：赔偿方案未谈拢

　　因对解决办法存在很大分歧，杨先生至今仍不肯让地铁施工单位清理家中半吨多的泥浆，而后者称同样无法满 足杨先生搬家换房的要求。

　　泥浆进屋居民要求换房

　　直至昨天下午，半吨多已经凝固开裂的泥浆仍堆放在朝阳区成寿寺路南双旗杆65号院杨先生家中。11月2 5日晚，这些水泥一夜之间出现在这处十多米的平房小屋(详见本报11月26日报道)。

　　紧挨着这处房屋的就是地铁十号线二期施工工地，事发后地铁施工方承认泥浆原本是用于给地下盾构机挖出的 隧道加固，可能由于土质问题，泥浆从8米深的地下经由空洞进入居民家中。

　　当施工方多次提出帮杨先生清理泥浆时，被杨先生拒绝。

　　杨先生和邻居们称，地铁建设时周围平房都已经拆迁，只有这处平房区的二三十户居民没有接到搬离通知。自 8月16日地铁启用盾构机在该平房区地下钻土以来，不少居民的房屋都已经开裂。

　　守着一屋子泥浆，杨先生和邻居们要求地铁施工方帮助他们搬家。

　　未曾违规工地只管赔偿

　　对于杨先生和邻居们的要求，地铁十号线二期02标段工地项目经理白先生显得很无奈。

　　白先生介绍，隧道距离地面的深度等问题已经经过专家论证，工地方也已经完成工地周边土质等勘查工作，工 地方没有违规行为。

　　"泥浆冲出地面这种事并不罕见，无法预料也无法避免。"白先生称，这些泥浆是水泥与玻璃水的混合物，可 能由于该处土质疏松或者有空洞，泥浆这才从八米深的地下钻出。

　　对此，施工方无法按照居民的要求"采取安全措施来预防"，只能事后赔偿或者补修。

　　对于杨先生提出的搬家换房条件，白先生更是表示不属于己方义务。白先生称，施工前搬迁的平房都属于小红 门乡政府，而65号院属于一家国企，因此没有同步拆迁。

　　目前，该地区地下注入泥浆的工程已基本完工,nike shoes uk。但对于这种突发状况，白经理表示无法预计也不能向其他居民保证不再发生。

　　大嘉律师事务所马凡勋律师告诉记者，此案例中，因地铁施工对居民造成了损害，地铁公司应对居民进行相应 赔偿。

　　如果评估结果显示，该施工对居民房屋存有安全隐患，且程度达到可拆迁范围,Nike Air Max Tailwind，那么地铁公司必须支付相应拆迁费用。
