男子锤击社保局科长案二审开庭

　　中新网深圳7月8日电 (陈文 王华兵)去年因申请提前退休未果锤击深圳社保局科长的倪顺义诉深圳市社会保险基金管理局养老保险行政案，倪 顺义不服一审判决提出上诉，7月8日在深圳市中级法院二审开庭。

　　倪顺义不服一审判决提出上诉。倪顺义认为原裁判认定事实错误。他自1971年12月在国营X矿参加工作 ，从事机修车间铀金属机械加工工作，工种为车工。国营X矿是从事铀矿开采、提炼的单位，机械设备就是铀金属 的一种。出于单位保密的原因，档案中未记录其从事铀金属加工的工作经历，而仅记载车工工种。国营X矿解散后 ，承接该矿权利义务的管理委员会出具证明，证明上诉人工种为车工(铀金属机械加工)，机修车间专为铀矿冶炼 设备加工、维修。因此应当认定上诉人的工种与劳动人事部、卫生部关于核工业提前退休工种的复函 (劳人护[1983]27号)规定的铀金属机械加工工种所包括的车工属于同一工种，即属于可提前退休的工种。认为一审认定事实错 误，上诉请求撤销一审判决，判令深圳市社会保险基金管理局在法定期限内对上诉人是否可提前退休，享受相应保 险待遇进行重新认定。
