男子谎称改造农贸市场诈骗2000万元

　　本报讯 （记者王纳）深圳一男子谎称拿到了一农贸市场改造的项目，以此为借口大肆行骗，先后骗取三人超过2000万 元。昨日，涉案的两名男子分别被控诈骗罪、非法经营罪在深圳中院出庭受审。

　　假造项目合伙骗钱

　　检察机关指控，2007年7月，刘某照伙同犯罪嫌疑人程某枝（另案处理）向被害人陈某真谎称，自己可以 拿到龙岗区平湖街道农贸市场改造项目（经主管机关证实并无该改造项目），共需要费用约3000 万元人民币,Nike Air Max Tailwind，由于资金不足，邀请陈某真一起参与投资该项目，并约好由陈某真投入一半资金，五五分成。

　　刘某照还带陈某真一起考察其谎称的平湖街道农贸市场改造的地址。陈某真考虑到其与程某枝、刘某照多年朋 友的关系，以及程某枝哥哥是香港上市公司老板的背景，遂信以为真。

　　2007年7月年至2008年1月期间，陈某真将人民币1300万元分多次转到刘某照提供的两个银行账 号。刘某照则按照其与程某枝事先商量好的计划，将钱转给被告人王某春。经查，转账给王某春共计人民币124 2.85万元，剩余人民币50余万元用于支付包括车辆的按揭、保险等费用。

　　2008年1月10日，由于陈某真资金紧张，他邀请其朋友被害人叶某鸿参与投资，叶表示同意。随后，叶 某鸿根据程某枝的要求，筹集了人民币338万元现金，用两个纸皮箱密封装好，交给程某枝雇请的司机杨某鹏。 杨某鹏按照程某枝的要求，将这两个纸皮箱送到王某春住处交给王某春。

　　2008年1月11日，刘某照和程某枝潜逃。王某春将刘某照转来的钱通过银行柜台转账或网上银行转账的 方式,nike shox，将钱分别转入其亲戚或朋友账户提现，连同程某枝司机交来的现金人民币338万元一同交给犯罪嫌疑人李某盛 （另案处理），通过李在香港将对等的港币存到程某枝和刘某照的银行账户,nike air max。

　　另查，2005年，刘某照伙同程某枝以平湖街道农贸市场改造项目需要筹集资金的名义，向被害人刘某辉（ 2008年3月18日因心肌梗塞病亡）“借钱”，谎称项目完成后，可以分相当一部分的铺位归刘某辉抵消“借 款”，这些铺位的出租收入也归刘所有。刘某辉信以为真，于2005年至2007年期间，先后交给程、刘二人 共计现金人民币490万元。2008年1月程、刘二人潜逃，该笔款项一直未还。

　　第一被告不承认诈骗

　　检察机关认为，刘某照以非法占有为目的，虚构事实，隐瞒真相，结伙骗取他人财物，数额特别巨大，应当以 诈骗罪追究责任。王某春在非国家规定的交易场所以外非法买卖外汇，扰乱市场秩序，情节严重，应当以非法经营 罪追究其刑事责任。

　　昨日在庭上，刘某照不认罪。他辩称，自己根本没有向陈某真说合作平湖街道农贸市场改造的项 目,cool nike air max，也不存在所谓的诈骗。

　　他辩解称，程某枝是其老板，每月发给他一两万元的工资，程老板和陈某真谈好，因做生意向陈某真借钱，约 定每月6分的利息，他只是负责帮程老板跑腿，将借来的钱转给王某春，通过王某春找人存入香港的账户，其余如 程老板具体做什么生意、为什么跟陈某真借钱等事情他均不清楚。刘某照当庭供述，陈某真和王某春都是做地下钱 庄生意的。

　　另一被告王某春则当庭表示认罪，并对检方指控的事实无异议。王某春称，他平时是在华强北做电子元器件生 意，偶尔帮朋友介绍转钱，他还称程某枝、刘某照给他两个在香港的账号，他把账号告诉李某盛，并且将程某枝他 们转给他的人民币交给李某盛，由李某盛在香港将这些人民币换成对等的港币存入程某枝、刘某照的香港账户。他 自己从中收取五六千元的报酬。

　　目前，此案还在进一步审理当中。
